(3.) This appeal has been filed against the order dated 03.09.2003 passed by learned Sub Judge-I, Deoghar in Title Declaration Suit No. 147 of 2003, whereby the plaint has been rejected by the learned court below under Order VII Rule 11 (d) of the Code of Civil Procedure.
