RAJA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.18/2020, Police Station Makrana, District Nagaur, registered for the offence under Sections 342, 365, 384, 392/34 of the Indian Penal Code and 3/25 Arms Act.

(2.) Learned counsel for the petitioner appearing through video calling stated that benefit of bail have already been granted by coordinate Bench of this Court to co-accused persons, namely, Gurupratap Singh Bhati, Malkeet Singh @ Malkiyat and Vijendra Singh Rajawat; charge-sheet has been filed; further investigation and trial will take sufficiently long time. With these submissions, learned counsel for the petitioner prayed that the benefit of bail may also be granted to the accused-petitioner.

(3.) Per contra, learned Public Prosecutor has opposed the bail application and stated that accused-petitioner belongs to Jalandhar, Punjab and three other cases are pending against the accused-petitioner.
