RAJU PAREEK Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application has been filed by the petitioners under Section 439 CrPC seeking regular bail in FIR No. 216/2020 registered at Police Station, Udhyog Nagar, Kota for the offence under Sections 269 and 270 IPC and Section 51 of Disaster Management Act and Section 19/54 of Rajasthan Excise Act.

(2.) Learned counsel for the petitioners has submitted that the accused petitioners are innocent and they have been falsely implicated in this matter. Co-accused Shyam has been granted bail by the Court below. The alleged offence is triable by a Magistrate, hence the petitioners may be enlarged on bail.

(3.) Learned PP appearing for the State has opposed the same.
