JUDGEMENT

(1.) WRIT petitioners are employees of State Road Transport Corporation. In respect of all the petitioners an order dated 31 -7 -1987 which is purported to have been issued under Art. 226 (2) of the J&K. Civil Service Regulations retiring them from 1st August, 1987, is challenged in these writ petitions.

(2.) IN the case of S. L. Sharma, he is said to have rendered 24 years of service. In writ petition no. 751/87, Abdul Qayam is said to have rendered 38 years of service. In writ petition no. 753/87 Romesh Chander is said to rendered 36 years of service. In writ petition no. 619/ 87 J.C. Kotwal is said to have rendered 28 years of service. S. N. Bhan petitioner in writ petition No. 755/1987 is said to have rendered 33 years of service. The column in respect of years of service rendered by vidhya sagar, petitioner in writ petition No. 752 is left blank. In all the petitions common questions of law and facts are canvassed before this court by the learned counsel for the parties who argued the cases at great lenght first at Jammu and then at Srinagar. There -fore these six petitions are decided by one judgement ,because challenge to the impugned order in all the petitions is same.

(3.) WRIT petitioners were first appointed in the Govt. transport under taking on different dates and on different posts which was a Govt. department it that time. Road Transport Corporation Act of 1950 was extended to the State of Jammu and Kashmir as a result of which state Road Transport corporation was established in the State on 1.9.1976.
