JUDGEMENT

(1.) PETITIONERS have challenged the seniority position of respondents 3 to 22 and have also challenged the promotion orders of respondents 3 to 8 as Deputy Directors.

(2.) FACTS relevant for the determination of the controversy are given as under: -

(3.) STATE is said to have framed Rule known as Jammu and Kashmir statistical -cum -evaluation Service Rules 1974 hereinafter referred to as ËœRulesâ„¢ on 20.4.1974. Conditions of appointment and seniority are envisaged in Rules 8 and 12 respectively. The recruitment to the post of Assistant Directors/Evaluation Officers/District Statistical officers are to be made from two channels, 50% by direct recruitment and 50% by promotion.
