(1.) Paramjit Singh through present petition filed by him under Article 226 of the Constitution of India, seeks direction to be issued to allow him admission in M.B.A. Course in Guru Nanak Dev University, Amritsar. It was way back in the year 1989 that this petition was filed and the Motion Bench while admitting the writ directed the respondents to admit petitioner in MBA course forthwith. This order was passed after the receipt of written statement on behalf of respondents and hearing the parties in the matter.
(2.) Mr. Mahajan inform me that petitioner has already completed his M.B.A. course and has cleared the same by securing 63% marks by way back in 1991, course being of two years. The challenge in the writ petition was to the change of eligibility criteria. 19% of the total seats were reserved for the candidates who had passed middle examination from rural areas. The eligibility criteria was changed from Middle pass to Matric pass from rural areas and it was this change brought about that was challenged in the present petition.

I need not go into the details and merits of the controversy involved in the present case as the petitioner has admittedly passed the course under contention way back in 1991 by securing 63% marks i.e. first division. It would be too-in-equituous at this stage to deny him the benefit of the interim orders passed by the Motion Bench as in the meanwhile the petitioner has not only been admitted but has passed the course about three years ago. This petition is, thus, allowed, Respondent- University shall issue marks-sheet and degree to the petitioner forthwith. No costs. Order dasti as welL
