BY filing this petition under Article 226 of the Constitution of India, the petitioners pray that their security deposits for a total sum of Rs. 60,47,585/ - (Rupees sixty lakhs forty seven thousand five hundred and eighty five) which, according to them are undisputed are not being paid by the respondents/State despite repeated representations made by the writ petitioners from time to time and hence filed this writ petition under Article 226 of Constitution of India for issuance of writ of mandamus against the respondents for release of the amount claimed.

IT is the case of the petitioners that they executed certain civil works which were awarded to them by the State Government and despite completion of the works in terms of the contract by the writ petitioners, the State Government is not releasing the security deposits and hence the petitioners are constrained to file this writ petition under Article 226 of the Constitution against the respondent State authorities for directing them to pay/release the amounts.

LEARNED counsel for the petitioners therefore, submits that the case of the petitioners should be examined by the State authorities in the light of the guidelines contained in the Full Bench decision in Shri LS Punii (supra), and if on verification, it is found that unpaid amounts claimed by the petitioners satisfy the guidelines, then the outstanding amounts claimed are paid to the petitioners.
