BY filing this petition under Article 226/227 of the Constitution of India, the petitioner prays that his bills for a total sum of Rs.3,25,000/ -(Rupees three lakhs twentyfive thousand), (Annexure A/1) which, according to him is undisputed one is not being paid by the respondents/State despite repeated representations made by the writ petitioner from time to time and hence this writ petition under Articles 226/227 of Constitution of India for issuance of writ of mandamus against the respondents for release of the amount claimed in his bills.

IT is the case of the petitioner that he did some civil works which were awarded to him by the State Government and despite completion of the works in terms of the contract by the writ petitioner and submitting the bills for the works done, the State Government is not releasing the money and hence the petitioner is constrained to file this writ petition under Articles 226/227 of the Constitution against the respondent - State authorities directing them to pay/release the amount raised by the petitioner in the form of the aforesaid bills.

LEARNED counsel for the petitioner therefore submits that the case of the petitioner should be examined by the State authorities in the light of the guidelines contained in the Full Bench decision in Shri LS Punii (supra), and if on verification, it is found that unlaid bills of the petitioner satisfy the guidelines, then the outstanding amount claimed in the bills be paid to the petitioner.
