(1.) In terms of our order dated 7th December, 2017, an opportunity was given to the appellant to bid a higher amount than what was bid by the respondent no.1/writ petitioner in the auction. The maximum amount which was bid by the appellant today in open Court was a sum of Rs.3,80,00,000/-. On the other hand, the respondent no.1/writ petitioner bid an amount of Rs.3,85,00,000/-.

As such, we find that the respondent no.1/writ petitioner is the highest bidder for long-term sand mining lease in respect of plot No.2041(P) Area 1.56 Acres, Mouza - Dakshin Mohanpur, Sand Block Serial no.Mohanpur/2041(P)A, Block and Police Station Jamalpur, District Purba Bardhaman, pursuant to the e-tender process, which was floated on-line, vide memo no.Miscl/667/MM/Auction/2017 dated April 13, 2017.
(3.) It is submitted by the learned advocate for the respondent no.1/writ petitioner that in terms of the order of the learned Single Judge dated 10th November, 2017, a part amount has already been deposited in terms of the etender conditions.
