JUDGEMENT

(1.) The petitioner No. 1 is an institute organized by Uttar Dinajpur Swasthya Sebayan, a Non-Government Organization for imparting training and programmes for orientation of the teachers in order to keep them abreast of the updated information and methodology of teaching. The first petitioner established the said institution at Halalpur Village within Runia Post Office in the district of Uttar Dinajpur. Subsequently, an application was made for recognition before the West Bengal Board of Primary Education which was duly accorded. The organizing body of the first petitioner decided to shift the institute from the existing site to new site i. e. at Village Naoda within the Post Office Baharail in the District of Uttar Dinajpur. Pursuant to the said decision, an application dated 25.6.2004 was made before the West Bengal Board of Primary Education for extending recognition at the new site. The permission to shift the site of the PTTI was declined and the recognition was provisionally granted for the session 2004-2005 at the original site i. e. village Halalpur on 9.07.2004.

(2.) By another letter dated 5.02.2006, the first petitioner again sought for permission to shift the said institute to Naoda village and the said application is still pending before the Board.

(3.) In the mean time, a public interest litigation (PIL) was filed by one Tulsi Bakshi & another being W. P. No 4107 (w) of 2006 against the recognition of Primary Teachers' Training Institute by the West Bengal Board of Primary Education in clear contravention to the provision contained under National Council for Teachers Education Act, 1993. It was contended therein that running of the unrecognized institute would be extremely hazardous as those institutes are not maintaining the standards as laid down in the National Council for Teachers Education Act, 1993. On 3rd March, 2006, while admitting the said PIL, an interim order was passed restraining the non-recognized Primary Teachers' Training Institute from admitting any further students for Primary Teachers' Training Course till the disposal of the writ petition and the certificate issued by such Institutes shall not be accepted as a valid qualification for appointment as trained candidates.
