(1.) THROUGH this application has been sought review of Tribunals orders dated 15.2.2006 whereby OA No. 275/2006 was dismissed. It has been contended as follows:
(2.) We have considered the above contentions raised on behalf of applicant. We have also considered the relevant case law as also the provisions of OM dated 7.6.1988 and OM dated 10.9.1993. In the OA had been cited on behalf of applicant 2004 (2) AISLJ (CAT) 204 Badri and Ors. v. Union Territory, Chandigarh and Ors. We have given reasons why the reliance placed on Badri (supra) is not applicable to the facts of the present case. Support was also drawn from the case of 2002 (2) ATJ 215 (SC) Union of India and Ors. v. Mohan Pal etc. etc. Not only this, we find that a Constitution Bench of the Honble Supreme Court in State of Karnataka v. Umadevi and Ors. 2006 SCCL.COM 243 (Civil Appeal Nos.3595-3692 of 1999 decided on 10.4.2006)] has laid at rest the entire issue ruling that temporary employees or those working on daily or contractual basis have no enforceable rights to be absorbed into service.
