JUDGEMENT

(1.) Petitioner seeks quashment of Rynjah P.S. Case No. 58(5) of 2019 which has been registered against him by a lady Pharmacist alleging therein that the petitioner Director NEIGRIHMS in the morning hours on 04.02.2019 visited her shop opposite to NEIGRIHMS for cordial discussion and advised her to carry out the business as per his instructions. Further, mentioned that he has cleared her bill for supply of peacemaker and some commission may be shared with him, he also tried to kiss her but she was a bit uncomfortable though she has not taken his approach seriously as in their culture they greet each other by cheek kissing however, she clearly refused to share the commission with him, that is the only reason for which he has harassed her.

(2.) It is contended that the allegations levelled are concocted because on 04.02.2019 the petitioner was in connection with official works in Delhi. In support of this submission, copy of a letter dated 01.02.2019 by the petitioner addressed to the Additional Secretary, Ministry of Health and Family Welfare, Govt. of India annexed with the petition reveals that the petitioner had to proceed to Delhi on 03.02.2019 for attending the office of the Ministry of Health and Family Welfare on 04.02.2019 (forenoon) for various official matters and thereafter, to attend the meeting of the SEC (Dermatology and Allergy) in the conference room, FDA Bhawan, New Delhi on 05.02.2019 as such, shall be grant the permission to leave station w.e.f. 03.02.2019 to 06.02.2019. Further, in support of the letter, copy of air ticket has been annexed revealing that the petitioner had departed on 03.02.2019 from Guwahati and had departed back from Delhi on 06.02.2019 at 9.30 A.M.

Learned AG pointed out that the complainant has subsequently addressed a letter to the Chairperson, Meghalaya State Commission for Women, Shillong conveying that there is a clerical error in her complaint dated 03.02.2019 so as to show that the occurrence has taken place on 01.02.2019 instead of 04.02.2019.
