JUDGEMENT

(1.) THE present petition is filed against order dated 05. 04. 2008 rendered by the learned Principal Senior Civil Judge, Ankleshwar below application Exh. 35 in Special Civil Suit No. 64 of 2007. 1. 1 The original plaintiffs - respondents herein moved application Exh,35 seeking amendment by adding certain paragraphs and also certain reliefs in the prayer clause.

(2.) HEARD Mr. Kapadia, learned advocate for the petitioners.

(3.) THE learned advocate for the petitioners took all pains to point out to this Court the contents of the plaint and the contents of application No. 35. He submitted that by the proposed amendment, the original plaintiffs have sought to change the nature of the suit and have also tried to bring the suit, which was otherwise beyond the period of limitation, within limitation.
