JUDGEMENT

(1.) By this petition the Petitioner seeks anticipatory bail in case FIR No. 774/2013 under Section 354 I.P.C. registered at PS Rajouri Garden. Learned counsel for the Petitioner contends that the Petitioner has been falsely implicated. There is a FIR against the complainant herself under Sections 307/452/506 I.P.C. Further the complainant has lodged number of cases against number of other people. General public in the area is also disturbed by the activities of the complainant.

(2.) Learned APP for the State has taken me through the contents of the FIR.

(3.) Heard learned counsel for the parties. The allegations against the Petitioner in the present FIR are that the Petitioner is involved in the sale and purchase of old cars and the Petitioner with bad intention used to call the complainant at his shop again and again. On 29th November, 2013 at a hour 11.00 AM the Petitioner came at the house of the complainant to collect registration certification of the car and negotiate the deal, where he started obscene talks with her. When she was going to kitchen to get a glass of water the Petitioner caught hold of the complainant and outraged her modesty. In the statement under Section 164 Cr.P.C. the complainant while reiterating her allegations in the FIR also stated that immediately after the incident the Petitioner apologized to the complainant. In view of the facts and circumstances of the case, I deem it fit to grant anticipatory bail to the Petitioner. It is therefore directed that in the event of arrest the Petitioner be released on bail on his furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that he will join the investigation as and when directed by the investigating officer.
