JUDGEMENT
K.SAMPATH, J. -
(1.) The complainant in C.O.P.No.107/2003 on the file of the District
Consumer Disputes Redressal Forum, Tiruvarur, is the appellant herein.
The case of the complainant was as follows:-
(a) Without notice to the complainant, the opposite parties had removed
the electricity meter from his premises. They also directed the
complainant to pay Rs.400/- which was done by the complainant through his
Village President. No receipt was given for the same. The opposite
parties directed the complainant to pay Rs.298/- for making entry in the
white meter card of the complainant. The complainant caused a lawyer
notice to be issued on 17/06/2006 to the opposite parties. The opposite
parties sent an evasive reply. The opposite parties also refused to
accept Rs.93/- being the actual consumption charges utilised by the
complainant. In these circumstances, the complaint came to be filed.
(2.) The opposite parties took the stand as follows: - The electric meter
was removed in the presence of the complainant as the meter, meter board
and meter glass were damaged due to rain. The opposite parties had also
clearly given the details with regard to the amount demanded in the white
meter card itself. Meter glass break charges Rs.103/-, Current
Consumption charges Rs.182/- and Board Audit charges Rs.13/- totalling to
Rs.298/-. This amount was not paid by the complainant and hence his
service was disconnected. The opposite parties were ready to restore the
connection provided the complainant made the payment of Rs.373/-
including reconnection charges of Rs.75/-. The opposite parties had
strictly followed the procedure laid down by the Electricity Board. There
was no deficiency in service.
(3.) Before the District Forum, on the side of the complainant Exs.A1 to A3
were marked while on the side of the opposite parties Exs.B1 to B3 were
marked.;
