JUDGEMENT

(1.) The Appellants as complainants filed a complaint before the District
Forum, Salem, alleging deficiency against the opposite parties to pay
Rs.2,00,000/- as compensation with interest at 18% and with a cost of
Rs.2000/-. The District Forum, allowed the complaint against the opposite
parties. Against the said order, this appeal is preferred by the
complainants, praying to set aside the order of the District Forum,
Salem, dated 22.03.07 in C.O.P.No.63/2003.
This appeal coming before us for hearing finally on 25.04.2011, upon
hearing the arguments of the counsel on both sides, and perused the
documents, written submissions as well as the order of the District
Forum, this Commission made the following order :-
(2.) In both these appeals the complainant have filed complaint against the
opposite parties for deficiency of service regarding the payment of
interest in the NSS account and thereby prayed for compensation of
Rs.2,00,000/- with interest at 18% and for cost of Rs.2,000/-.
(3.) The details of the complaint in brief are as follows :- The
complainants have opened N.S.S. account with the 1st opposite party on
various dates to the tune of Rs.1,10,000/- and Rs.90,000/- from 31.3.1989
to 28.2.92 and CA from 24.3.92 to 28.2.92 respectively and the 1st
opposite party was paying specified interest till 1999 without any
objection. On 27.2.1999 when the complainant tendered pass book for entry
of interest 1st opposite party refused to add interest and closed the
account forcibly and the complainant paid principal amount only. It is
stated for keeping more than one account under NSS scheme the interest
will not be given and therefore arbitrarily closed the account and the
2nd opposite party was addressed for regularization of those accounts and
for conversion of clubbing those accounts in to one but in vain. Hence
the Arbitrary acts of the opposite parties rendered liable to cause
mental agony to the complainant. Hence they come forward with this
complaint for the reliefs as above.;
