JUDGEMENT

A.K.ANNAMALAI J. - (1.) The Respondents as complainants filed a complaint before the District Forum, Theni, alleging deficiency against the opposite party to issue the Transfer Certificate for the son of the 1st complainant immediately, to repay the fee of Rs.17,335/- paid by the 1st complainant, Rs.5,00,000/- as compensation for compelling the 1st complainant to admit his son in the hostel and Rs.5,00,000/- as compensation for mental agony with Rs.5,000/- as costs and Rs.200/- for each hearing date of this complaint. The District Forum, allowed the complaint against the opposite party. Against the said order, this appeal is preferred by the opposite party, praying to set aside the order of the District Forum, Theni dated 20.12.07 in O.P.No.136/2007. This appeal coming before us for hearing finally on 28.04.2011, upon hearing the arguments of the counsel on both sides, and perused the documents, written submissions as well as the order of the District Forum, this Commission made the following order :- The opposite party is the appellant.

The complainants/respondents filed a complaint against the opposite party before the District Forum to issue the Transfer Certificate for the son of the 1st complainant immediately, to repay the fee of Rs.17,335/- paid by the 1st complainant, Rs.5,00,000/- as compensation for compelling the 1st complainant to admit his son in the hostel and Rs.5,00,000/- as compensation for mental agony with Rs.5,000/- as costs and Rs.200/- for each hearing date of this complaint.
(3.) On the basis of materials placed before the District Forum, the District Forum allowed the complaint by directing the opposite party to issue the Transfer Certificate to minor Praveen, the son of the 1st complainant within 30 days from the date of this order and to pay Rs.5,00,000/- as compensation for mental agony due to deficiency of service with 12% interest from the date of this complaint till realization of the amount and Rs.2,500/- as costs.;
