JUDGEMENT

M.THANIKACHALAM, J. - (1.) The 2nd opposite party, in OP.No.32/2002, on the file of District Forum, Thanjavur, who suffered an adverse order, is the appellant.
(2.) The complainant/1st respondent, who had obtained a working visa, at Kuwait, approached the 1st opposite party, for taking necessary arrangement, to go to Kuwait, who in turn, took him to the 2nd opposite party, to whom they have handed over the original passport of the complainant, bearing No.A.2963161, alongwith air ticket, who in turn sent the same to one Santhosh Apsar Consultancy, Delhi, through the 3rd opposite party. The complainant having waited for 20 days, and considering the fact, the visa period was nearing, approached the 1st opposite party, and both went to the 2nd opposite party, who evaded to give any positive reply, thereby they have committed deficiency, and the consequential result was, the period of visa expired, preventing the complainant from going to abroad, seeking job, shattering the hope of earning also. Subsequent enquiry revealed, that the 3rd opposite party lost the parcel, who had sent it to Delhi, for which, all the respondents are jointly liable. If the opposite party had performed their duties, the complainant would have reached Kuwait, earned atleast Rs.75000/- per month, which was deprived of, for which they are liable to pay the minimum compensation of Rs.450000/-. For the recovery of this amount, the case was filed.

The 1st opposite party, more or less supporting the case of the complainant, would contend, that due to the deficiency in service, on the part of the opposite parties 2 and 3 alone, if at all the complainant would have been put to loss, for which he cannot be held responsible, thereby he prayed that he should be relieved.;
