JUDGEMENT

(1.) The opposite party having suffered an adverse order, in the hands of
the District Forum in OP.No.26/2009 dt.25.02.2010, challenges the same in
this appeal, as appellant.
(2.) The complainant?s case in brief:
The complainant/ respondent had borrowed loan of Rs.1 lakh, from the
opposite party, depositing his original title deed on 22.3.1974, in Group
No.53706/34. He had repaid the loan, and the entire loan was discharged
as on 19.9.2006. After the discharge of the loan, when the complainant
demanded the original title deed, which was entrusted as security, it was
not returned, thereby the opposite party committing deficiency in
service, prevented the complainant from selling the property, in order to
meet the expenses of his daughter?s marriage, thereby caused mental agony
also. They have insisted to sign in a paper, as if the complainant had
received all the documents, not agreed, having lost the original title,
in respect of the property, bound to return of the original document, as
well a compensation of RS.80,000/-, with cost of Rs.10000/-. Hence the
complaint.
(3.) The opposite party/ appellant, had not contested the case, resulting
an order against them, where a direction has been given to return the
original sale deed, within two months, as well as a total sum of
Rs.20000/- as compensation, towards mental agony and deficiency in
service, with interest thereon, in addition to cost of Rs.2000/-, which
is challenged.;
