JUDGEMENT

(1.) The opposite parties are the appellants.
(2.) The respondent/ complainant, who had joined in the college, run by the
opposite parties in B.Com degree course, for the academic year 2002-2005,
discontinued the course from 3rd year, and requested to return back his
+2 certificate, and transfer certificate, which the opposite parties
failed, insisting tuition fees for 3rd year, which should be construed as
deficiency, as well as negligent act, thereby sought a direction to
return back his +2 mark sheet and the transfer certificate, in addition
to a sum of Rs.1 lakh as compensation, under three headings.
(3.) The opposite parties, admitting that the complainant joined in their
college, resisted the case, contending that the complaint is not
maintainable, since the complainant left on his own from the college,
after attending 17 days, during third academic year, that when on his own
he left the college, requesting to return back +2 certificate, and
transfer certificate, without paying fee, as per the conditions available
in the prospectus, amount was insisted, which the institution is legally
entitled to, cannot be termed as deficiency in service, praying for the
dismissal of the complaint.;
