M.THANIKACHALAM J. - (1.) The opposite parties are the appellants.
(2.) The respondent in this appeal, as complainant, being a subscriber of the telephone connection No.279353, had received bill, for the period from 16.7.98 to 15.9.98, wherein a direction was given to pay the sum of Rs.2437/-. Verification of the bills brought to surface, that the bills were not proper, resulting a complaint to the opposite parties, as if there was excess amount claimed, than the actual user over period. The issuance of notice also failed to rectify the mistake, and according to the complainant, demand notice calling upon the excess amount, would amount to deficiency in service, further causing mental agony, loss of reputation, harassement etc. Therefore, a complaint came to be filed against the opposite parties, for the recovery of a sum of Rs.2 lakhs, as compensation.
(3.) The opposite parties/appellants, opposed the claim, on various grounds, justifying the demand, thereby informing, that there was no deficiency of service, and the bills were based upon actual meter reading, etc., denying the entire averments in the complaint.;
