APARESH KUMAR SINGH,J. - (1.) Two affidavits have been filed- one by the NHAI and other by the P.W.D (Road), Government of Jharkhand. NHAI in its affidavit has, on one hand, given the progress under four packages of work in relation to the expansion and widening work of NH-33; it has also referred to certain hurdles being faced at certain sections of the Highway, for which District Administration / State Government is required to cooperate. (2.) Learned Senior counsel for the NHAI has submitted that while progress of work in the first three packages is more or less up to the mark, but under package-IV, it is not up to the mark, for which agency has also been hauled up by the Ministry of Surface Transport. NHAI is taking active steps to ensure that work in package-IV does not suffer and is completed within the projected date i.e. 10.12.2020.
(3.) On perusal of the details of actual physical work under different packages enclosed as Annexure-A series, the items in respect of which no significant progress of work has been shown under package-II, are item no. 8-Major Bridges, item no. 9- Flyovers and item no. 10-Elephant Underpasses. These are major items which need sufficient time to be completed as per the work programme submitted by the agency. Learned Senior counsel for the NHAI submits on instruction that certain testing work was being undertaken on the incomplete structures at river Kanti. The remaining main work would start if the unfinished structures are found to be safe and sound. The work programme of Major Bridges, Flyovers and Elephant Underpasses shows 240 days for its completion. We expect the aforesaid major items of works to be taken in right earnest, so that the work is completed within the scheduled date. ;
