JUDGEMENT
Sujit Narayan Prasad, J. -
(1.) This writ petition is under Article 226 of the Constitution of India, whereby and whereunder a direction by way of declaration has been sought for, to the effect that once a Society is registered under Section 3 of the Societies Registration Act, further registration of the Society is not required.
(2.) This Court, without going into the details of the factual aspect, has straightway, come to the stand taken by the respondents in the counter affidavit with respect to nature of prayer of the writ petition, whether it still survives and has found by going across the stand taken by the respondents at paragraph 7, wherein it has been stated that the Governing Body of the College has been constituted under Section 8 (1) of the Bihar Homeopathic Medical Teaching Institute (Regulation & Control) Act, 1987 but after coming into force of Central Homeopathic Council Amendment Act, 2002, the Governing Body of the College was dissolved vide memo no. 134(20) dated 24.05.2016.
(3.) In view of such stand, having been taken by the respondents and taking into consideration the fact of enforcement of Central Homeopathic Council Amendment Act, 2002, by which, the Governing Body of the College has been dissolved, nothing remains to be adjudicated in this writ petition.;
