JUDGEMENT

- (1.) These writ petitions are having common prayer and therefore, all these writ petitions are directed to be listed together and accordingly, they have been heard together and now disposed of by this common order.
(2.) The prayer has been sought for in these writ petitions are for restraining the respondents in making any construction over the plot details of which is being furnished in the aforesaid writ petitions which is being quoted hereinbelow:- i. In W.P.(C) No.2029 of 2017:- Khata No.10, Plot No.4, 220, 529, 542, 213, 475, 487, 496, 462, 460, 508, 28, 536, 543 total area of 44.75 acres situated at Mauza Jadutand No.5, P.S.-Jainagar recorded with name of Bodhi Gope. ii. In W.P.(C) No.2031 of 2017:- Khata No.9, Plot No.216 and 514 total area of 12.53 acres situated at Mauza Jadutand No.5, P.S.-Jainagar recorded with name of Budhan Gope. iii. In W.P.(C) No.2039 of 2017:- Khata No.12, Plot No.511 and 515 total area of 15.57 acres situated at Mauza Jadutand No.5, P.S.-Jainagar recorded with name of Bbhatu Gope. iv. In W.P.(C) No.2050 of 2017:- Khata No.8, Plot No.3, 125, 199, 18, 211, 29, 228, 218, 279, 509, 517, 482, 461, 537, 546 total area of 40.23 5/7 acres situated at Mauza Jadutand No.5 P.S.-Jainagar recorded with name of Badhan Gope. v. In W.P.(C) No.2051 of 2017:- Khata No.4, Plot No.219, 498, 489, 477, 463, 535, 541, 551, total area of 19.41-1/2 acres situated at Mauza Jadutand No.5 P.S.-Jainagar recorded with name of Ugar Gope.
(3.) The petitioner grievance is that they are raiyatis of the land in question as per the details furnished in the said paragraphs and for widening of the proposed road, the authorities have decided to acquire the same but without following the proposition as per the statutory provision applicable, therefore learned counsel for the petitioners has approached this Court by invoking the extraordinary jurisdiction under Article 226 of the Constitution of India.;
