JUDGEMENT

(1.) THIS writ petition has been preferred for issuance of an appropriate writ, order or direction upon the respondents to pay exgratia amount/compensation for the damages sustained in 1984 Sikh Riot following of assassination of Smt. Indira Gandhi(Ex -Prime
Minister of India) in view of Rehabilitation Pakage sanctioned by Ministry of Home Affairs, Government of India, to provide relief to the victims of 1984 Sikh Riot as the petitioner and his family members has been ravished during that Riot which includes damage to their garage and burning of vehicle being run by and under banner of M/s Khalsa Transport and its Partner, which was a partnership firm, and altogether the petitioners family and its partners business lossed to the tune of Rs.64,50,000/ -which was also certified by the then Deputy Commissioner, Hazaribagh. His further prayer is for payment of exgratia compensation with interest as assessed by the respondents in accordance with several directions of the Central Government as well as State Government. The counsel for the petitioner has referred to a batch of decision passed by a Division Bench of this Honble Court in W.P.(C) No.3784 of 2005 along with connected matters which was disposed of on 15.5.2008.
The main contention raised by the counsel for the petitioner is that he has been identified by Deputy Commissioner, Hazaribagh who certified the loss occurred of petitioners father during the riot. He further prays that in the light of the order and direction passed by this Honble court in the aforesaid writ petition at para 7 and 8, this writ petition may be disposed of.
The direction issued by a Division Bench of this Honble Court at para 7 and 8 vide order dated 15.5.2008 passed in W.P.(C) No.3784 of 2005 along with connected matters is quoted as under:
"7. Now, in view of the stand taken by the Central Government with reference to the constitution of Rehabilitation Package announced by the Central Government on 16.1.2006, which is uniformly applicable to all the affected States including Jharkhand, the State Government has to proceed with the enquiry through the Committee for assessing the quantum of the damage or loss suffered by the victims.
(2.) SINCE it is now stated by the State Government that already instructions have been given to the Deputy Commissioners of all the concerned districts directing them to make enquiries after taking evidence from the parties and decide about the claims and claimants who are the victims in the 1984 Sikh Riots, all the petitioners can approach the respective Deputy Commissioners and produce the materials to enable the Committee to come to the proper assessment of the damages. This process must be completed within six weeks from the date of receipt of a copy of this order.
In the, light of the aforesaid direction issued by this Honble Court, this writ petition is disposed of with a direction to the petitioner to approach the concern Deputy Commissioner for redressal of his grievance.;
