JUDGEMENT

- (1.) This writ petition has been field for seeking the post retiral benefits by the petitioner.In paragraph-8 of the counter affidavit it is stated that the following payments to the petitioner have been made on account of his retiral benefits which reads as under: "1. Payment of gratuity-pen-1-334 dated 16.04.08 - Rs. 283140.00 2. Payment of Pension- Provisional - Rs. 5400.00 final PPO DGR EDN 14825 dated 16.04.08 - Rs. 6000.00 3. GPF - Vide bill no. 141/2006-07 - Rs. 62306.00 4. Group insurance - memo no. 402 dated 08.03.06 - Rs. 15236.00 5. Leave encashment- memo no. 402 dated 08.03.06 -Rs.76648.00 entire" In paragraph-14 of the counter affidavit the respondents had stated as under: "That vide letter no.32 dated 26.6.08 the D.D.O Middle School Uperbahiyar has shown his inability to place request of allotment to pay the salary of petitioner in absence of his attendance register from his first date of joining i.e. 4.10.90 to December 1992. The attendance register from January 1993 to January 2001 is available and request of allotment for payment for the period January 1993 to January 2001 is in progress".
(2.) In view of the above, it is apparent that the respondents have paid certain amount to the petitioner whereas some outstanding dues are still pending, which is admitted to the respondents. The petitioner shall make a representation to the respondents indicating the details of the arrears and the post retiral benefits within a period of one month alongwith a copy of this order and the respondents would dispose of the representation of the petitioner by making a speaking order expeditiously and preferably within a period of four months thereafter.
(3.) It is needless to say that if there is a delay of payment, the authority will also consider the question of interest payable to the petitioner.This writ petition is accordingly disposed of with the aforesaid directions.;
