JUDGEMENT
-
(1.) The petitioner has filed this petition for the following
relieves:-
(a) Overtime allowances : Since January 1997 to
March, 2001(dues approx Rs. 54,000/-)
(b) Delay Interest @ 8.5% P.A. on delayed payment
of G.P.F. as per Section 14(4) of the G.P.F. Rules.
(c) Delay Interest @ 6% per annum u/s 34 of C.P.C.,
1908 on account of delayed payments of Over-time
allowance and other allowances.
(d) Other legal entitlements.
(2.) It is alleged that the petitioner has not been given the
payment of overtime allowances as well as interest of G.P.F
amount and delayed payments. It is alleged in paragraph-7 of the
writ petition, that the petitioner has also filed representations dated
30.09.2003, 22.08.2004, 18.03.2006 and 12.11.2007 before the
respondents for the payment of his retiral benefits including the
overtime allowances and other dues but said request has not been
considered.
(3.) In the facts and circumstances of the case, it would be
just and proper, without going into the merit of the petition, to
direct the respondents to dispose of the representation of the
petitioner expeditiously and preferably within a period of four
months from the date of the presentation of a copy of this order
before the competent authority.
This writ petition is accordingly disposed of with no
order as to costs.;
