JUDGEMENT

(1.) Prayer in the writ petition is for a direction upon the respondent-State to appoint him on the post of clerk or any other equivalent class-III post. He seeks to challenge the letter of appointment dated 24.06.2007 by which he has been appointed as constable.

After the death of his father on 20.01.1998, the petitioner submitted an application for his appointment on compassionate ground, however, it was declined on the ground that he has crossed the age for appointment. He came to this Court in W.P.(S) No. 1523 of 2004 which stood disposed of by an order dated 20.12.2006 with a direction to the respondent-authority to take a decision on his application for compassionate appointment. From this order it does not appear that the petitioner raised a claim for appointment to the post of clerk or any other equivalent class-III post. There is no discussion on the aforesaid claim, if any, made by the petitioner in the previous writ proceeding. After remand, when a decision was taken to offer appointment to the petitioner on the post of constable and for this vide letter dated 24.06.2007 he was directed to produce requisite certificates, aggrieved, he came to this Court for a direction upon the respondents to appoint him on the post of clerk or any other equivalent class-III post. For laying claim for appointment on the post of clerk, the petitioner has not pleaded any specific rule which entitles him to seek appointment as clerk. A person seeking compassionate appointment cannot lay a claim over a particular post; primary object for compassionate appointment is to extend support to the family in distress after the death of the bread-earner and not to accommodate a person allegedly claiming higher qualification on a post according to his wishes.
(3.) In the above facts, finding no infirmity in the decision of the department to offer compassionate appointment to the petitioner on the post of constable, the writ petition is dismissed.;
