Shree Chandrashekhar, J. - (1.) Prayer in the writ petition is for a direction upon the respondents to pay post-retiral benefits including Provident Fund amount and arrears of salary as claimed under prayer (C).

The respondents have filed affidavits in this matter taking a stand that Baidyanath Kamal Kumari Sanskrit Upshastri (Inter) College, Deoghar is an aided affiliated college (Inter level) and the teachers working there are not entitled for pension and other post-retiral benefits. It is pleaded that grant of pension and other post-retiral benefits to the persons working in aided affiliated institutions is a policy matter and at present the government has not taken a decision to pay pension and other post-retiral benefits to the employees of aided affiliated institutions.

A similar issue came before this Court in W.P.(S) No.3013 of 2017 and W.P.(S) No.3016 of 2013 and this Court by an order dated 13.10.2017 while dismissing the writ petitions has held that teachers working under Baidyanath Kamal Kumari Sanskrit (Inter) College, Deoghar cannot claim pension/post-retiral benefits.;
