JUDGEMENT

(1.) In essence, the petitioner seeks compassionate appointment. From the affidavits filed in the present proceeding, it appears that now the respondent-SAIL has taken a decision to offer compassionate appointment to the petitioner, however, subject to a condition that monetary benefits availed by him shall be recovered from his salary, in installments. The petitioner has filed an affidavit withdrawing his earlier undertaking which was submitted "under protest", and unconditionally undertaking that the amount of monetary compensation may be recovered from his salary in terms of the conditions imposed by the respondent-company vide its letter dated 03.06.2017.
(2.) The learned counsel for the petitioner does not press the prayers at clause-'C' and 'D'.
(3.) Accordingly, it is held that on grant of compassionate appointment to the petitioner the impugned order dated 24.12.2003 stands quashed. The respondent no.2- Deputy General Manager (P&A), Steel Authority of India Ltd., Raw Materials Division, Industry House, 10, Camac Street, Kolkata-700017 is directed to issue necessary instructions for appointment of the petitioner on a suitable post, within four weeks.;
