- (1.) THIS writ petition has been preferred for issuance of a writ, order or direction commanding upon the respondents to consider the case of the petitioner for compassionate appointment inasmuch as his father late Bhola Nath Rai died -in -harness on 13.9.2002, while working and posted as Security Guard at Bokaro Thermal Power Station, Bokaro.

THE circular, as referred to by the learned counsel for the respondents, on the face of it appears to be contradictory inasmuch as it allows the new claimants to continue to get the benefit as per the old circular whereas the petitioner is denied the benefit of the aforesaid circular, which is on the fact of it discriminatory. The respondents are, accordingly, directed to take a decision with regard to claim of the petitioner for compassionate appointment in accordance with the certificate granted by them in the year, 2003, within a period of three months from the date of receipt/production of a copy of this order.
(3.) THIS writ petition stands disposed of with the aforesaid observation.;
