JUDGEMENT

(1.) THE present writ petition has been preferred for issuance of an appropriate writ, order or direction for quashing the common order dated 14th October, 2005 passed by Shri Pankaj shrivastava, learned Presiding Officer, Labour Court, Jamshedpur in mw Case No. 1/2002, 2/2002, 3/2002, 4/2002, 5/2002 and 6/2002 and for further quashing the order dated 15th September, 2008 passed by Shri Ravindra Nath Verma, learned Presiding Officer, Industrial tribunal, Ranchi in MW Appeal No. 1/2005 and also to restrain the respondents not to proceed with the execution case pending before the court of learned Sub-Divisional Judicial Magistrate-cum-Certificate Officer, Chaibasa in connection with Miscellaneous Case No. 4/06.
(2.) THE main contention raised by the petitioners is that the application was time barred as provided under Section 20 (1) of minimum Wages Act 1948. He has further submitted that no reason has been assigned for condoning the delay nor any opportunity was given to the petitioners herein.

I have perused the order and I find that in paragraph 14 the learned Presiding Officer has considered the issue of limitation and has also assigned reasons for condoning the same based on the assertion made by the applicant witness. It has been specifically stated that applicants therein had initially approached D. L. C. and other authorities for redressal of their grievance and they have further stated that pursuant to a tripartite agreement dated 26. 2. 2000 payment was made to the applicants with a clause to adjust the interim payment after issuance of notification for Minimum Wages.;
