JUDGEMENT

(1.) Learned counsel appearing for the petitioner, learned counsel appearing for the State and learned counsel appearing for the Respondent No. 6.
Learned counsel appearing for the petitioner submits that the petitioner was earlier working as Clerk in the office of Civil Surgeon -cum -Chief Medical Officer, Hazaribagh and being senior to all, the petitioner later on was assigned to discharge the duty of Head Clerk but subsequently, Respondent no. 6 -Rameshwar Ram was posted in the office of Civil Surgeon -cum -Chief Medical Officer, Hazaribagh and was assigned to do the job of the Head Clerk, though, he was junior to the petitioner and hence this writ application was filed, challenging the order of transfer of respondent no. 6 on the post of petitioner, but subsequently, an order has been passed by the Civil Surgeon -cum -Chief Medical Officer, Hazaribagh, as contained in Memo No. 1889 dated 23.09.2008, whereby the petitioner as also the respondent no. 6 have been asked to handover the charges to one Syed Naqi Ahmad in anticipation of the order of transfer being passed under the direction of the Director -in -Chief, Health Services, Ranchi.
(2.) HOWEVER , learned counsel for the respondent no. 6 submits that he is never junior to the petitioner.
Be that as it may, it appears that through this writ application, the order of transfer of respondent no. 6 to the place of the petitioner was challenged but subsequently, an order has been passed as contained in Annexure -17, whereby both the petitioner and the respondent no. 6 have been asked to handover the charges to third persons in the wake of order likely to be passed relating to the transfer of the petitioner as also the respondent no. 6.
In that view of the matter, I do not intend to interfere with the order as contained in Annexure -10/1 of the writ petition.
Accordingly, this writ application is disposed of.
