JUDGEMENT
SHREE CHANDRASHEKHAR,J. -
(1.) Petitioners in this batch of writ petitions were appointed on the post of Anganwari Sevika/Sahaika on different dates; some of them were appointed far back in the year 1983. For absence from duty for one day, they have been terminated from service by different orders. Date of inspection in all the cases was 12.03.2016, when Anganwari centers were allegedly found closed. In the counter-affidavit, the respondents have taken a similar stand. It is, thus, an admitted position that for absence of one day from duty these petitioners have been terminated from service.

In W.P.(S) Nos. 2960 of 2016, 2964 of 2016 and 2966 of 2016, considering the representation submitted by them, the Deputy Commissioner who is the appellate authority has cancelled the order of termination of these three petitioners from service. In the counter-affidavit filed in W.P.(S) No. 2964 of 2016 and W.P.(S) No. 2966 of 2016 the respondents have disclosed that by an order dated 07.10.2016 order of termination from service of these three petitioners has been cancelled, however, in this batch of writ petitions, no reason, except, that there is a provision for appeal, has been disclosed by the respondents, why a similar benefit cannot be granted to these petitioners. It appears that the appellate authority itself has taken a decision to give one more opportunity to the petitioners in the above-mentioned writ petitions and consequently, order of termination has been cancelled.

Considering the aforesaid facts, these writ petitions are disposed of with liberty to the petitioners to approach the appellate authority for filing an appeal within a period of four weeks, on which the appellate authority shall pass an order within next four weeks. During this period, no proceeding for fresh appointment on the posts which were held by the petitioners shall be initiated. It is expected that benefit which has been given to the petitioners in W.P.(S) Nos. 2960 of 2016, 2964 of 2016 and 2966 of 2016 shall be extended to these petitioners also.;
