Anant Bijay Singh, J. - (1.) All these applications are heard together and disposed of by this common order as all these cases arising out of same case being R.C.No.12(A)/2014-R, registered under Section 120B, 420, 468, 471 read with Section 13(2) R/w 13 (1) (d) of the P.C. Act.
(2.) The brief facts of the case is that one S.K.Khare, Superintendent of Police/HOB, CBI, ACB Ranchi got information from reliable source that one Dalando Thanmi Khathaing, the then Vice-Chancellor, Central University of Jharkhand (CUJ), Ranchi, Narendra Pal Garg, OSD(Project), Central University of Jharkhand, entered into a criminal conspiracy with the proprietors/Directors of four private firms viz. M/s Anil Associates, New Delhi, M/s Space Ace, Gurgoan, M/s Gray parikh Architects Pvt. Ltd., Ahmedabad, M/s Sandeep Shikre Architects & Associates, Mumbai and unknown other during the period 2010 to 2014, and committed the offence of cheating, forgery for the purpose of cheating, using forged/fake documents as genuine and criminal misconduct, and in pursuance thereof, by abusing their official position, caused a wrongful gain of Rs.1,92,08,774 (Approx) to the above mentioned private firms and corresponding wrongful loss to the Central University of Jharkhand, Ranchi, in the matter of award of consultancy work for preparation of master plan and comprehensive architectural building designing and engineering design for the Permanent Campus of Central University of Jharkhand, on the basis of bogus fake documents and by making fraudulent payments to the said firms.

During course of investigation it appears that the Central University of Jharkhand floated an expression of interest (EOI) vide No. CUJ/ArchConst./2011-12/10/Adv./001 for developing the permanent campus of Central University of Jharkhand at Ranchi. It was mentioned in the EOI that the Vice Chancellor, CUJ is pleased to organize a Pre-Bid conference with the reputed National/ International Consultants dealing in Architectural Planning, Structural Planning, etc. The EOI further was clear about the winners wherein it was mentioned as below:- Model Plan Winners Award First prize: Work Awarded Second Prize: Rs.1.5 lacs only Third Prize: Rs.80,000 only;
