JUDGEMENT

S. N. Pathak, J. - (1.) The petitioner has approached this Hon'ble Court with a prayer for direction upon the respondents to consider the case of the petitioner for re-medical examination before the Apex Medical Board in view of the orders passed in connected similar writ petition bearing W.P.(S)No.670/2017 and W.P.(S)No.5981/2017. Further prayer has been made to appoint the petitioner on the post of Forest Guard if he is declared successful and found fit in accordance with law and he figures in the merit list.
(2.) There was an advertisement floated by the State Government for appointment of Forest Guard having advertisement No.03/2014. The petitioner having fulfilled all the requisite criteria for appointment of the Forest Guard, applied for the same and was issued Admit Card. On issuance of Admit Card, the petitioner appeared in the preliminary test which was conducted on 24.05.2015. The petitioner was declared successful and as such he was called for the mains examination and he appeared in the same conducted on 15.5.2006 and was also declared successful. Upon being declared successful, the petitioner was medically examined and in the medical examination he was found unfit by the respondent-authorities i.e. Medical Board constituted by the State. The petitioner having declared unfit by the Medical Board got himself examined by one Medical Officer of the RIMS in the premises of RIMS itself and he was declared medically fit. The petitioner was not having flat foot as earlier observed by the Medical Board duly constituted by the State. The petitioner having certificate of RIMS wherein he was declared medically fit approached the respondentauthorities for consideration of his case as the similar cases were considered by the Commission as well as State authorities. When the same was not considered, the petitioner has knocked the door of this Hon'ble Court.

Mr. Rajesh Kumar, learned Counsel appearing for the petitioner streneously urges that similar issues have already been decided by this Hon'ble Court and as such a similar direction be given to the respondent-authorities to consider the case of the petitioner for appearing before the Apex Medical Board as it was done in other similar cases.;
