JUDGEMENT

(1.) Heard learned counsel for the appellant-State and the learned counsel for the accused-respondent.
(2.) This appeal has been filed by the appellant-State against the impugned Judgment of acquittal dated 29th May, 2014, passed by the learned Additional Sessions Judge IV, Dhanbad, in S.T. No.129 of 2012, whereby the sole respondent, who had faced the trial for the offences under Sections 302, 307 of the Indian Penal Code and Section 27 of the Arms Act, has been acquitted after trial.
(3.) The impugned Judgment and the LCR show that although thirteen witnesses, including the Investigating Officer and the Doctor, were examined by the prosecution to bring home the charges against the accused respondent, but the informant P.W.-3 Jitendra Pandy @ Nemu Lal Pandey, who was the eye witness to the occurrence and had named the accused, had not supported the prosecution case during trial and had turned hostile. Some of the other witnesses also turned hostile and the prosecution case was supported only by the interested witnesses, who were the close relatives of the deceased.;
