JUDGEMENT

(1.) I.A. No. 5810 of 2016
Heard Mr. B.M. Tripathy, learned senior counsel appearing for the appellant, and Mr. Ravi Kumar Singh, learned Addl. P.P. appearing for the State, on the Interlocutory Application bearing I.A. No. 5810 of 2016, wherein prayer has been made to enlarge the appellant on bail.
(2.) Mr. Tripathy submitted that the appellants have been convicted for the offence under Section 302 of the Indian Penal Code and have been sentenced to undergo imprisonment for life besides fine. Learned counsel further submitted that the appellants were all along on bail during trial and they never misused the liberty granted by the Court and after passing of judgment of conviction and order of sentence, they were remanded back to jail and since then they are languishing in jail custody. It is further submitted that there is no eye witness to the occurrence. It is further submitted that there is no direct evidence against the appellants. It is further submitted that this appeal is not likely to be heard within ten years and therefore, the appellants may be released on bail.
(3.) Mr. Ravi Kumar Singh, learned Addl. P.P. appearing for the State, has vehemently opposed the prayer for bail of the appellants and submitted that the appellants have committed murder of the deceased and therefore, they do not deserve to be released on bail.;
