JUDGEMENT

(1.) This writ petition has been filed for the following prayers:
"That in the instant writ application the petitioner prays of issuance of an appropriate writ/Rule/Direction to the respondents particularly to the respondent no. 2 to issue 'No Objection Certificate' to the petitioner for taking admission in Post Graduate Course of Session 2016 -18 since she has been declared successful in Post Graduate Medical Admission Test -2016 held by Jharkhand Combined Entrance Competitive Examination Board, Ranchi holding the 7th rank in In -service CML Rank and 2nd rank in In -Service CAT Rank taking into consideration that the course is going to commence from 31st May, 2016. And for any other relief or reliefs to which the petitioner may be found entitled"
(2.) Learned counsel for the petitioner has submitted that the petitioner is an employee of the State Government and
presently posted at RIMS, Ranchi. It is further submitted that Post
Graduate Medical Admission Test -2016 has been held by
Jharkhand Combined Entrance Competitive Examination Board,
Ranchi and the course is going to commence from 31st May,
2016.
(3.) Clause 8.2 laid down Educational Criteria which reads as under:
(a.) The candidate must have passed MBBS Examination from any University/Medical College of Jharkhand State.
(b) The candidate must have completed the Rotating Internship.
(c)The candidate have obtained permanent Registration from Medical Council of India or Bihar/Jharkhand State Medical Council.
(d). Those candidates who are resident of Jharkhand admitted in MBBS course in the Medical Colleges of Bihar in the Sessions started from 2000 creation of Jharkhand State or admitted in Medical Colleges of Bihar before the creation of Jharkhand State and have passed MBBS may also apply as per Government of Jharkhand notification no. 9/vivid -13 -05/2012 65(9) Health/Ranchi dated 07.05.2013.
(e) The candidates who have passed MBBS examination from any University/Medical College as per the requirements of 8.2(a) and 8.2(d) above but have not completed the Rotating Internship may also apply to appear in PGMAT -2016 on provisional basis subject to the condition that they must complete the Rotating Internship satisfactory on or before 31.03.2016 otherwise they shall not be allowed to participate in the counseling even if their name appears in the merit list.
(f) A candidate, who did not obtain permanent registration from Medical Council of India or Bihar/Jharkhand State Medical Council but is otherwise eligible, may be allowed to appear in PGMAT -2016 on provisional basis but he must obtain the same from Jharkhand Medical Council within one month from the date of his admission in P.G. Course as per the rules of the Medical Council of India failing which the admission of the candidate shall be cancelled. Also, he must be registered after admission under the concerned University within the period prescribed by that University. ;
