JUDGEMENT
VIRENDER SINGH,C.J. -
(1.) Challenging the order of dismissal from service on the
ground that in an exparte departmental proceeding without
examining the victim from whom the appellantwrit petitioner
(hereinafter to be referred as "petitioner") had snatched
Rs. 17,000/ at the Dhanbad Railway Station and without
adducing evidence in support of the said charge he could not have
been inflicted punishment of dismissal from service, the petitioner
approached the Writ Court in W.P.(S) No. 2710 of 2011, which
now stands dismissed vide judgment dated 06.11.2015.
(2.) On 16.05.2016, to a query posed by the Court whether a criminal case was registered against the petitioner for snatching
Rs. 17,000/ from a passenger at the Dhanbad Railway Station,
the counsel for the parties sought adjournment. Today, Dr. S.N.
Pathak, the learned Senior Counsel for the petitioner states that a
criminal case vide F.I.R No. 36 of 2008 for offence under
Section 384 I.P.C. was registered against the petitioner on 28.07.2008. The learned counsel for the State has produced copies
of F.I.R. and chargesheet along with the record of the
departmental proceeding.
