JUDGEMENT

(1.) HAVING heard counsel for the parties and being satisfied with the grounds shown therein, the delay of 18 days in preferring this appeal is condoned. The LA. No. 230/06 stands disposed of.
The appellants applied for appointment to the post of Primary Trained Teachers in the State of Jharkhand. They appeared in the written test conducted by the Jharkhand State Public Service Commission (hereinafter referred to as JPSC) but were not declared successful. In the writ petition, the appellants prayed for direction on the respondents to consider their cases for appointment to the post of Primary Trained Teachers on the ground that they have been discriminated as their cases have been rejected on the ground they are not the residents of the State of Jharkhand.

THOUGH we accept the submission as made on behalf of the appellants that no person can be discriminated on the ground of place of residence, but in the present appeal, no writ can be issued on the respondents, there being nothing on record to suggest that the appellants were not declared successful only because of their place of residence. No pleading has been made by the appellants that any person having obtained lower marks than the appellants has been declared successful or recommended for appointment or appointed to the post of Primary Trained Teacher. If the appellants have not been provided with the details of information with regard to the marks obtained by them or marks obtained by the last candidate of their respective category, whose names have been recommended for appointment in the district of Chatra, they may request JPSC to provide the details or may exercise their right under the Right to Information Act. If any such application is filed, JPSC will pass appropriate order and may provide the details. On receipt of such information, if it is found that one or other appellant has obtained higher marks than the persons who have already been recommended or appointed, the JPSC may reconsider the case of such appellants for appointment. If any adverse decision is taken, in such case the appellants may move before a Court for appropriate relief.;
