JUDGEMENT

- (1.) WE have considered the report submitted by the Committee set up by the Ministry of Human Resources Development, in view of the order passed in this petition, filed as Public Interest Litigation.
(2.) PRIMA facie, after going through some facts, we are of the opinion that the report itself requires serious consideration as we found that report may not be complete as well as may not be answering the question which even taken note of by the Committee. For example, we may take note of one of the question which was for consideration before the Committee and that was "Illegalities and irregularities in the construction of the Director's chambers and its furnishing". The allegation taken note of by the Committee is " the Director withdrew more than Rs.20.00 lakhs for the construction of Director's chamber after demolishing the labs of the computer centre which were in very good condition and had been recently constructed for the benefit of students". Inspite of taking note of this as a first issue under the heading 9 of the report, neither facts have been mentioned nor any comment has been given by the Committee for this issue. However, from the finding, it appears that the issue was much graver than alleged. The Committee found that wood paneling for the chambers of the Director was at the cost of Rs.99,00,620/ . The Committee did not mention what was the measurement of the Director's Chamber. Whether wood paneling in Director's chamber could have costed almost one crore rupees and whether there was any justification for such a huge expenditure for wood paneling in the chamber of the Director. The Committee noticed that even furnitures were purchased by calling four quotations and not through open tender notice. The Committee also found that Rs.76,510/ was spent for the Director's chamber and Rs.3,41,500/ - for the office of the Visitor's room. Then it appears from the report that the said expenditure was also for the Director's chamber and the room attached to the Director's chamber.
(3.) THEN under the same heading, it is mentioned that so far furnitures are concerned, a Furniture Purchase Committee was constituted and it purchased furniture worth Rs. 1,21,06,363/ . In the report, one Annexure C9 has been annexed to show the expenditure incurred for furniture. From which it appears that those furnitures were purchased for various purposes which includes furnitures for class rooms and hostels.;
