JUDGEMENT

(1.) Heard learned Counsel for the petitioners. No body appears on behalf of the State.
(2.) THE petitioners, who are accused for offences under Section 498 -A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act pray for anticipatory bail expressing apprehension of their arrest in connection with Hazaribagh Sadar P.S. Case No. 24 of 2005.
Learned Counsel for the petitioners submits that the petitioners have been falsely implicated in this case only on account of the fact that petitioner No. 1 happens to be the brother -in -law of the complainant while petitioner No. 2 is the wife of petitioner No. 1. Learned Counsel further submits that the petitioners have no concern whatsoever with the complainant, as because they are separate in mess and residence as well as business from the husband of the complainant and, therefore, it cannot be believed that the petitioners are indulged in the alleged ill -treatment of the complainant. The allegation that the husband of the complainant was mentally ill, is totally false and misleading, as because the husband of the complainant is a graduate and running his own business of the jewellary shop. Learned Counsel explains that other accused persons, namely, Ram Lagan Sao, Uttam Devi, Harihar Sao and Hemant Kumar Verma have been granted anticipatory bail by this Court in ABA No. 1241 of 2005 while the father -in -law and mother -in -law of the complainant have also been granted anticipatory bail by this Court in ABA No. 1242 of 2005 and the petitioners also deserve the same privilege.
(3.) CONSIDERING the facts and circumstances of the case, prayer for anticipatory bail to the petitioners is allowed. Both the petitioners, abovenamed, are directed to surrender themselves before the Court below within fifteen days from today, and on their surrender, they shall be released on bail on furnishing bail bond of Rs. 10,000 (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Hazaribagh Sadar P.S. Case No. 24 of 2005 arising out of G.R. No. 153 of 2005, subject to the conditions laid down under Section 438(2) Cr PC.;
