JUDGEMENT

(1.) THIS revision is against the order of the trial court refusing to allow the petitioners to appear through their counsel on the dates of hearing in the criminal trial.
(2.) THE learned counsel appearing for the petitioners submits that the petitioner no. 1 is the resident of Patna and petitioner no. 2 is the resident of Kolkata and both of them are Non -Executive Directors of the Company and to appear in court on all the dates of hearing will cause great prejudice not only to themselves but also to the growth of the Company. He submits that if they are permitted to appear through their counsel, no prejudice will be caused to the prosecution. He also submits that the petitioners are prepared to appear before the learned Magistrate on any date or dates fixed by the Magistrate, if their presence is required and that they will also appear for answering the questions under Section 313 of the Code of Criminal Procedure. He further submits that the petitioners' exemption will not stand in the way of the early disposal of the case.
On the submissions and after hearing Mr.T.N. Verma, learned A.P.P., appearing for the State, I feel that the petitioners can be permitted to appear through their counsel by filing petitions under Section 205 of the Code of Criminal Procedure. It is made clear that the petitioners should appear on the date/dates fixed by the Magistrate, if required by him, for any specific purpose and the petitioners should also appear before the learned Magistrate for answering the questions under Section 313 of the Code of Criminal Procedure as well as on the date of the judgment.
(3.) WITH the aforesaid observation and direction, this revision is disposed of.;
