JUDGEMENT
S. Chandrashekhar, J. -
(1.) Aggrieved by the Transfer Certificate/School Leaving Certificate issued on 8.9.2015 by the Ramakrishna Mission Vidyapith, Deoghar the present writ petition has been filed. The learned counsel for the petitioner submits that the petitioner is a brilliant student, who has always secured 85 -90% marks in all the examinations. Though the petitioner denies his involvement in the incident which allegedly occurred on 1.9.2015, expulsion of the petitioner from Ramakrishna Mission Vidyapith, Deoghar is a punishment so excessive and disproportionate that it shocks the conscience of the Court. It is contended that the expulsion of the petitioner from the Vidyapith in the garb of issuing Transfer Certificate would seriously affect the future of the petitioner, inasmuch as the petitioner may not be admitted in any other school.

I find that along with the letter dated 9.9.2015 whereby, the father of the petitioner was informed that Transfer Certificate would be issued to the petitioner a copy of the proceedings of the Disciplinary Committee was also provided to him. The proceedings of the Disciplinary Committee disclose that on 1.9.2015 six students were found together with cold drink bottles, plastic glasses filled with whisky/beer, empty bottle of whisky etc. Blood samples of those six students were taken and the tests were conducted at Dr. Lal Path Labs. New Delhi. The test report disclosed presence of alcohol. The petitioner was one of the six students. In the meeting of the Disciplinary Committee in presence of monk -administrators, teachers, dham wardens etc. an unanimous decision was taken to ask all the six boys to leave the school. The father of the petitioner was also informed about the same and consequently. Transfer Certificate dated 8.9.2015 has been issued. I find that the Transfer Certificate issued to the petitioner is not stigmatic. In the matters of administration of the educational institutions, the Court's role is minimal and interference by the Court in the matters pertaining to maintenance of discipline is generally not warranted. The blood samples were sent for laboratory test in one of the reputed laboratories at New Delhi and the test report has revealed presence of alcohol. I find no reason to disbelieve the facts disclosed in the proceedings of the Disciplinary Committee. Considering the aforesaid facts, I am not inclined to interfere in the matter and accordingly, the writ petition is dismissed.;
