JUDGEMENT

(1.) All these criminal miscellaneous petitions arise out of the same case and as such, they are taken up together and disposed of by this common order.
(2.) Heard learned counsels for the petitioners and learned counsel for the State, as also learned counsel for the complainant-opposite party No.2.
(3.) The petitioners have filed these criminal miscellaneous petitions for quashing the entire criminal proceeding against them in C.P. Case No. 1301 of 2005, including the order dated 9.1.2006 passed therein, by Sri Alok Kumar, learned Judicial Magistrate, Dhanbad, whereby, on the basis of the statement of the complainant recorded on solemn affirmation, as also the statements of the witnesses recorded at the enquiry stage, the Court below has found prima facie offence under Sections 420, 406, 467, 468, 471 and 120-B of the Indian Penal Code, against these petitioners, including the petitioner Asit Baran Sengupta, on the ground that this petitioner was also a witness to the sale deed, even though he was not even made an accused in the case, rather, he was only a witness in the case.;
