JUDGEMENT

(1.) Heard learned counsel for the petitioners, learned counsel for the State as also learned counsel for the complainant O.P. No. 2.
(2.) The petitioners have challenged the order dated 16.5.2006, passed by Sri K.K. Prasad, learned Judicial Magistrate, 1st Class, Jamshedpur, in Complaint Case No. C/1-01 of 2006, finding prima facie offence under Sections 406/34 of the Indian Penal Code against the petitioners, as also the entire criminal proceeding against the petitioners in the said case.

The petitioners are the President, Secretary and Treasurer of the Jharkhand State Cricket Association, and they have been made accused in complaint Case No. C/1-01 of 2006, which has been filed by the complainant, claiming himself to be the proprietor of M/s. M.M. Enterprises. It is stated in the complaint petition that the accused persons, issued a formal work order for supply of one Score Board containing the display and key board, to the complainant, which was duly supplied by the complainant and a bill of Rs. 90,720/- was submitted by the complainant. It is alleged that the said bill was not paid to the complainant, and accordingly, the complaint case was filed. There is also other allegation against the accused persons to have threatened the complainant, and thereby criminally intimidated the complainant, when the complainant had gone to take payment in the office of the petitioners, upon being called for settlement of the bill. However, the fact remains that no prima facie offence has been found against the petitioners for criminal intimidation and there is no challenge to the order by the complainant for not taking cognisance for the said offence.;
