JUDGEMENT

(1.) On second call also, counsel for the petitioners is absent. On the previous date of hearing also, counsel for the petitioners was absent.
(2.) Seeking quashing of order dated 28.05.2013 whereby, application for creation of Jamabandi has been rejected, the present writ petition has been filed.

The petitioners have pleaded that the land in Mauza Thethangi, Thana No. 86, Khata No. 3, Survey Khewat No. 2/1 comprised in various plots, total area 19.83 acres was recorded in the name of Ramchandra Ganjhu. The said Ramchandra Ganjhu paid rent from 1974 to 1979 and after the vesting of jamindari his descendant namely, Jhubara Ganjhu came in possession. Subsequently, the said Jhubara Ganjhu shifted in another village and he gave the aforesaid land on Batai. His son Suresh Ganjhu gave the said land to Yogendra Ganju and Chandramohan Mistri. On the application of Suresh Ganjhu, the Circle Officer forwarded the recommendation affirming that the land comprised in Khewat No. 2/1 within Khata No. 3 was recorded in the name of Ramchandra Ganjhu as Bakast Malik and he remained in possession over the same. The Humuknama produced by the opposite parties, Adward Tigga and Alexandar Tigga was disbelieved by the Circle Officer. In the order dated 28.05.2015, the Deputy Collector Land Reforms noticed the report of Deputy Commissioner, Chatra, who affirmed that the opposite parties were in possession over the land in question. Considering the fact that the rent receipts were issued from 1952-53 to 2008-09 in the name of Joseph Tigga and he has been found in possession, the Deputy collector Land Reforms dismissed the application filed by the petitioners as timebarred, as the same was filed 60 years after the vesting of jamindari. I find no infirmity in the impugned order dated 28.05.2013 and accordingly, the writ petition is dismissed.;
