JUDGEMENT

(1.) Pursuant to our last order dated 6th July, 2015, Mr. Sanjay Kumar Suman, Member Secretary, Jharkhand State Pollution Control Board, Ranchi has appeared in person.
(2.) Mr. Anil Kumar Sinha, learned senior counsel appearing for the Jharkhand State Pollution Control Board, Ranchi has drawn the attention of the Court to the order dated 5th September, 2013 (para-4 of the order). It reads,
"4.Having heard the counsel for both the sides and looking to the facts and circumstances of the case, it appears that vital public interest is involved in this public interest litigation. The State of Jharkhand has also no data about the total number of hospitals, nursing homes, clinics, dispensaries, pathological laboratories and blood banks etc. which are generating Bio Medical Wastes. We direct the Member Secretary of the Jharkhand State Pollution Control Board to file an affidavit at least on the following points:
(a)to give details about the total number of hospitals, nursing homes, clinics, dispensaries, veterinary institutions, animal houses, pathological laboratories and blood banks private and public both with the name of occupier their addresses and if possible with landline telephone numbers;
(b)as required under Rule 5 (2) of the Rules, 1998 whether every occupier as defined under Rule 3 (8) has set up within time scheduled given in the Rules, 1998 the requisites bio medical waste treatment facilities like incineration, auto clave, microwave system etc;
(c)whether every occupier/operator is submitting the annual report to the prescribed authority in form no.
(ii) by 31st of January every year. The information about the categories and quantities of bio medical wastes handled during the preceding year."
(3.) In the said order, Director-in-Chief, Health Services, Government of Jharkhand was directed to point out on oath whether hospitals, nursing homes, clinics, dispensaries, pathological laboratories and blood banks etc. are being registered or given licence by the competent authorities or not.;
