JUDGEMENT

(1.) HEARD learned counsel for the parties. These two petitioners were appointed as Range Forest Officer, through letter at Annexure -1 dated 19.11.1986. The appointment letter itself indicates that before appointment, they would be sent for training in the year 1987. They were asked to submit joining on 10.12.1986, which the petitioners claim to have done. Training started from 1.3.1987 vide Annexure -3. Petitioners got ACP/MACP vide notification dated 16.2.2013 of the Department of Environment and Forest, Annexure -5 reckoning the period of their service from 1.3.1987 when they were sent for training. Resolution dated 26.8.2010, Annexure -6 of the same department is also to the effect that period spent under training by the Range Forest Officer should be counted for the purposes of grant of ACP benefits. Now petitioners have claimed that their date of appointment should be reckoned from 10.12.1986 and 8.12.1986 respectively on their joining pursuant to the appointment letter at Annexure -1.

THIS plea at this stage is not only unworthy to be entertained, but at the same time it is contrary to terms and conditions of the letter at Annexure -1, which categorically specified that petitioners would have to undertake training before their appointment. Their training commenced from 1.3.1987. That period of training has now been included for the purposes of grant of ACP in view of the resolution at Annexure -6 dated 26.8.2010. This notification granting ACP/MACP vide Annexure -5 shows that it applies uniformally to all such persons in the cadre of petitioners. The date of their service is treated from the date of their training i.e. mostly w.e.f. 1.3.1987 and thereafter w.e.f. 1.3.1988 in respect of certain other persons. Therefore, such plea for correction of date of joining is not worthy to be granted as no grounds are made out. Accordingly, the writ petition is dismissed.;
